App Terms & Conditions

NZLA App Terms of Use

Last Updated: September 2026

These Terms of Use (“Terms”) apply to your access to and use of NZLA, including the NZLA iOS app, web app, website-based services, accounts, lawn journal, My Journey, reminders, application guides, calculators, weather and soil-temperature information, plant and weed identification, AI-assisted features, forum, posts, comments, stories, profiles, notifications, subscriptions, shop and related services (together, the “Service”).

NZLA is operated by New Zealand Lawn Addicts Limited, trading as NZLA and New Zealand Lawn Addicts (“NZLA”, “we”, “us” or “our”).

By creating an account, accessing or using NZLA, you agree to these Terms and our Privacy Policy. If you do not agree, you must not create an account or use the Service.

Our Privacy Policy forms part of these Terms and explains how personal information is collected, used, stored and disclosed.

1. About NZLA and Acceptance of These Terms

NZLA provides lawn-care information, planning tools, community features, subscription features, digital services and access to physical lawn-care products.

The Service is intended for users in New Zealand and is operated subject to New Zealand law.

These Terms apply to the relationship between you and New Zealand Lawn Addicts Limited in connection with your NZLA account and use of the Service.

If you access NZLA through Apple’s App Store, additional Apple terms apply to the licence for the iOS application as explained below.

2. Eligibility and Accounts

You must be at least 16 years old to create or use an NZLA account.

When creating and using an account, you agree to:

  • provide information that is accurate and reasonably current;
  • keep your login credentials secure;
  • take reasonable steps to prevent unauthorised access to your account;
  • promptly tell us if you believe your account has been accessed or used without permission; and
  • remain responsible for activity occurring through your account where that activity results from your actions or failure to take reasonable security precautions.

You must not sell, transfer, share or commercially provide access to your account without our permission.

We may request reasonable identity, account or ownership verification where necessary to protect an account, investigate suspicious activity, process an account request, prevent fraud or comply with law.

3. Licence to Use the App

NZLA and its software are licensed to you, not sold.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use NZLA for lawful personal use.

If you use the NZLA iOS app, your licence to the iOS application is also governed by Apple’s Standard Licensed Application End User License Agreement:

https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

Apple’s Standard EULA governs the licence to the iOS application where applicable. These NZLA Terms separately govern your NZLA account, services, content, community participation, subscriptions, shop and your relationship with New Zealand Lawn Addicts Limited.

Except where applicable law expressly permits otherwise, you must not:

  • copy, reproduce, modify, distribute or resell the app or its software;
  • reverse engineer, decompile or attempt to extract source code;
  • interfere with the normal operation or security of NZLA;
  • carry out penetration testing, vulnerability testing or security testing without permission;
  • attempt to bypass subscription, access, authentication or other technical controls;
  • use automated systems in a way that materially disrupts the Service; or
  • use the Service for an unlawful purpose.

4. Subscription Features

NZLA may offer paid subscriptions or memberships that provide access to additional features.

Depending on the subscription, device, platform and features available at the time, paid features may include:

  • lawn journal and lawn tracking;
  • application guides;
  • weather integration;
  • product-rate calculators;
  • plant or weed identification;
  • community features;
  • soil-temperature information;
  • personalised reminders; and
  • other premium or subscription features introduced from time to time.

The exact features included in a subscription may evolve as NZLA is developed.

Some features may depend on your location, device capabilities, operating system, internet connection, permissions, third-party data providers or other technical requirements.

5. Apple App Store Subscriptions

NZLA may offer monthly and annual auto-renewable subscriptions through Apple’s App Store.

The exact current subscription price in New Zealand dollars will be displayed on Apple’s purchase screen before you confirm the purchase.

When you purchase an Apple App Store subscription:

  • payment is charged to your Apple Account when the purchase is confirmed;
  • the subscription automatically renews for the same subscription period unless auto-renewal is turned off;
  • Apple may charge your account within 24 hours before the end of the current subscription period;
  • the price applying to your purchase or renewal is handled through Apple’s purchase and subscription processes;
  • price changes will be dealt with in accordance with Apple’s processes and applicable law; and
  • subscription access may be available across supported devices where you are signed into the appropriate NZLA and Apple accounts.

Managing or Cancelling an Apple Subscription

Apple App Store subscriptions must be managed through Apple.

You can view, manage or cancel an Apple subscription at:

https://apps.apple.com/account/subscriptions

Cancellation prevents future renewal but will normally leave your paid subscription access available until the end of the current paid subscription period.

Deleting the NZLA app does not cancel your Apple subscription.

Deleting your NZLA account also does not automatically cancel your Apple subscription.

If you intend to delete your NZLA account and you have an active Apple subscription, you should first cancel the subscription separately through your Apple subscription settings.

Apple Billing and Refunds

Apple processes payments for subscriptions purchased through the App Store. NZLA cannot directly cancel or issue a refund for a transaction billed by Apple.

Apple purchase and refund support is available at:

https://reportaproblem.apple.com/

You may also be able to use a Restore Purchases function within NZLA where available to restore eligible subscription access associated with your account.

Nothing in this section limits any rights you may have under applicable New Zealand consumer law.

6. Website and Stripe Subscriptions

NZLA may also offer subscriptions purchased through its website. Website subscriptions may be processed through Stripe or another authorised payment provider.

Website subscription pricing, promotions, billing arrangements and trial eligibility may differ from subscriptions available through Apple’s App Store.

The web service may offer monthly or annual subscription options and may, where expressly offered at checkout, include a one-time seven-day trial.

A free trial is not guaranteed for every user, subscription or platform.

Trial eligibility may depend on:

  • the particular offer being made;
  • previous subscriptions or trials;
  • the relevant billing platform; and
  • other eligibility conditions displayed with the offer.

Where a trial automatically converts to a paid subscription, the applicable price and renewal terms will be displayed before you complete checkout.

Website subscriptions must be managed using the NZLA or Stripe subscription-management method provided for that subscription.

Apple App Store subscriptions must be managed through Apple. Stripe or website subscriptions must be managed through the applicable NZLA or Stripe subscription portal.

Some existing customers may continue to be billed through the billing provider originally associated with their subscription.

7. Physical-Product Shop

NZLA may operate a shop through which users can purchase physical lawn-care products and other goods.

Physical-product purchases are separate from NZLA’s digital app subscriptions.

Payments for physical goods may be processed by Stripe or another authorised payment provider.

Product availability, delivery, returns, refunds and other matters relating to physical goods are governed by the shop policies applying to the relevant purchase and by applicable New Zealand consumer law.

Apple does not process or fulfil NZLA physical-product orders and is not involved in those transactions.

When using a lawn, garden, chemical, fertiliser, pesticide or other physical product, you are responsible for reading and following:

  • the manufacturer’s label;
  • application instructions;
  • safety warnings;
  • personal protective equipment requirements;
  • storage and disposal instructions; and
  • applicable legal requirements.

8. Trials, Promotions and Rewards

NZLA may offer trials, discounts, introductory offers, rewards, promotions or other benefits from time to time.

These offers may:

  • have specific eligibility requirements;
  • have start or end dates;
  • be limited to particular users or platforms;
  • be limited to one use per person or account;
  • exclude users who have previously received a similar trial or promotion; or
  • be subject to additional terms displayed with the offer.

The specific terms displayed at checkout or alongside an offer take priority over more general promotional wording where there is an inconsistency.

Where permitted by law, NZLA may correct an obvious pricing, technical or eligibility error.

Promotional or earned benefits must not be sold, transferred or exchanged for cash unless the applicable offer expressly allows this.

9. User-Generated Content

NZLA allows users to create, upload or submit content. This may include:

  • forum posts;
  • comments and replies;
  • stories;
  • Journal entries;
  • My Journey content;
  • profile information;
  • photographs and images;
  • lawn information;
  • reports;
  • feedback;
  • questions and answers; and
  • other content submitted through NZLA.

Ownership

You retain ownership of original content that you create and submit to NZLA.

By submitting content, you grant NZLA a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce and display that content only to the extent reasonably necessary to operate, secure, moderate and provide the Service in accordance with your selected visibility settings and these Terms.

This licence does not transfer ownership of your content to NZLA.

Public Content

Content that you choose to publish in public areas may be visible to:

  • other NZLA users;
  • people who do not have an NZLA account;
  • search engines; and
  • internet caching and archiving services.

You should not publish personal or confidential information that you do not want to become publicly available.

Your Responsibilities

You must have all rights, permissions and consents reasonably necessary to upload or publish content through NZLA.

You remain responsible for content you submit.

You must not upload content that unlawfully infringes another person’s intellectual property, privacy or other rights.

Private Content

Content designated as private will not intentionally be published publicly by NZLA.

However, authorised NZLA personnel and service providers may access private content where reasonably necessary to operate, maintain, secure, moderate, troubleshoot or support the Service.

Deletion of content and personal information is handled in accordance with our Privacy Policy, legal retention requirements, system backups and the practical limitations of third-party search, caching and archive systems.

10. Community Standards and Prohibited Conduct

NZLA is intended to provide a useful and constructive community for lawn-care enthusiasts.

You must not use NZLA to create, upload, publish, send or promote:

  • illegal content or activity;
  • threatening, abusive, harassing or hateful content;
  • sexual or seriously objectionable content;
  • bullying or targeted harassment;
  • spam, scams or fraudulent activity;
  • impersonation or materially misleading identity claims;
  • content that unlawfully infringes intellectual-property rights;
  • another person’s private information without authority;
  • malware or code intended to interfere with or compromise NZLA;
  • attempts to manipulate reactions, rewards, subscriptions or access controls;
  • unauthorised advertising, commercial promotion or repeated solicitation;
  • attempts to evade blocks, moderation actions or account restrictions; or
  • conduct that creates a material safety risk or seriously disrupts the community.

Users may be able to report content and block other users using tools available within NZLA.

NZLA may investigate reports and, where reasonably necessary, remove content, reduce its visibility, restrict account features, suspend accounts or terminate accounts.

We do not promise to review or pre-screen every submission before it appears on the Service.

11. Moderation, Reports and Appeals

NZLA may use a combination of human moderation and automated systems to help identify spam, abuse, unsafe content, fraud or possible breaches of these Terms.

Automated systems are not perfect and may occasionally make incorrect assessments.

Where reasonably practicable, NZLA may consider factors such as context, seriousness, frequency, previous behaviour and potential risk when making moderation decisions.

We may preserve relevant content, account information or activity records where reasonably necessary to investigate reports, protect users, prevent fraud, maintain security or comply with legal obligations.

If you wish to raise a concern about a moderation decision, contact:

office@newzealandlawnaddicts.com

Reports must be made honestly. Reporting systems must not be deliberately misused to harass, intimidate or repeatedly target another user.

12. Lawn-Care Information and Safety Disclaimer

NZLA provides lawn-care tools, information and recommendations for general educational and planning purposes.

NZLA does not provide professional agronomic, chemical, medical, veterinary, environmental, engineering or legal advice.

Information generated or displayed by NZLA may include:

  • product application rates;
  • calculators;
  • weather information;
  • soil-temperature information;
  • evapotranspiration information;
  • growing-degree-day calculations;
  • watering guidance;
  • reminders;
  • lawn-care suggestions; and
  • other estimates or recommendations.

These outputs may be based on user-entered information, third-party information, formulas, forecasts, location information or automated systems. They should therefore be treated as estimates and general guidance rather than guaranteed results.

Weather, location, soil-temperature and other third-party information may sometimes be delayed, incomplete or inaccurate.

You are responsible for checking relevant calculations, product information and local conditions before acting.

A product’s official label, legal directions and safety instructions always take priority over information displayed in NZLA.

You are responsible for:

  • selecting products that are lawful and appropriate for your intended use;
  • checking application rates;
  • using required protective equipment;
  • following withholding, safety or re-entry requirements;
  • safe storage and disposal;
  • protecting people, animals, plants, waterways and surrounding property; and
  • complying with applicable New Zealand requirements.

To the maximum extent permitted by law, NZLA is not responsible for lawn, plant, property, environmental, animal or personal harm resulting from disregarding product labels, using a product contrary to its instructions, or relying solely on an estimate or recommendation provided through the Service.

Nothing in this section excludes liability or consumer rights that cannot lawfully be excluded.

13. Plant Identification and AI-Assisted Features

NZLA may provide plant identification, weed identification, image recognition, artificial intelligence or other automated features.

Automated and AI-generated results can be incomplete, uncertain or incorrect.

Plant or weed identifications and AI-generated responses are suggestions and should be independently verified where accuracy is important.

You must not rely on NZLA to determine whether a plant, fungus, substance or other item is safe to eat, touch, apply, feed to an animal or otherwise use in a way that may affect health or safety.

You should obtain appropriate professional advice where an identification or recommendation may affect:

  • human health;
  • animal health;
  • chemical use;
  • environmental safety;
  • poisoning risk; or
  • another significant safety issue.

Text, photographs or other information you submit to an AI-assisted feature may be processed by relevant service providers in order to provide the requested result, as further explained in our Privacy Policy.

14. Notifications

You may be able to opt into push notifications and other communications from NZLA.

Notifications may include:

  • account notifications;
  • forum and community notifications;
  • lawn-care reminders;
  • subscription notices;
  • service announcements;
  • security notices;
  • order information; and
  • optional promotional communications.

Notification delivery depends on factors outside NZLA’s complete control, including device settings, internet access, operating systems and third-party notification services.

Delivery is therefore not guaranteed.

You should not rely on an NZLA notification for safety-critical or time-critical activity.

Push notifications can generally be disabled through your device settings.

Marketing communications will include opt-out or unsubscribe controls where required by law.

Essential account, transaction, security or service communications may still be sent where reasonably necessary to provide services you have requested or operate your account.

15. Third-Party Services

NZLA depends on a range of third-party services and infrastructure to operate its features.

These may include services provided by:

  • Apple;
  • RevenueCat;
  • Stripe;
  • Supabase;
  • WordPress and WooCommerce;
  • OneSignal;
  • mapping and geocoding providers;
  • weather and environmental-data providers;
  • artificial-intelligence providers; and
  • other hosting, infrastructure and technology providers.

Some NZLA features may therefore depend on those services remaining available and functioning correctly.

Third-party providers may also have their own terms and privacy policies that apply to their services.

While NZLA takes reasonable steps in selecting and operating third-party services, we cannot guarantee that external services will always be available, uninterrupted or error-free.

Our responsibilities in relation to third-party services remain subject to applicable law and any rights that cannot lawfully be excluded.

16. Intellectual Property

NZLA owns or licenses intellectual property associated with the Service, including, where applicable:

  • software;
  • branding;
  • logos;
  • interface design;
  • databases;
  • original lawn-care guides;
  • written content;
  • graphics; and
  • other NZLA materials.

Using NZLA does not give you ownership of NZLA intellectual property.

NZLA names, logos, software and original content must not be copied, reproduced, commercially reused or distributed without permission except where permitted by law.

User-generated content remains owned by its creator, subject to the limited operational licence described in these Terms.

If you believe content on NZLA infringes your intellectual-property rights, contact:

office@newzealandlawnaddicts.com

17. Availability, Updates and Changes

NZLA may update, improve, modify, replace, add, suspend or discontinue parts of the Service as the platform develops.

Access may occasionally be interrupted because of:

  • maintenance;
  • software updates;
  • network problems;
  • hosting failures;
  • third-party outages;
  • security incidents; or
  • other technical or operational issues.

Where reasonably practicable, we will seek to provide reasonable notice of material changes that significantly and adversely affect users.

Changes to features do not remove subscription obligations or statutory consumer rights where those obligations or rights continue to apply.

You may need to install app or operating-system updates to continue using some features or to maintain security and compatibility.

18. Account Suspension and Termination

You may stop using NZLA at any time and may request account deletion through the account or privacy settings made available in the app.

NZLA may restrict, suspend or terminate access where reasonably necessary because of:

  • a serious or repeated breach of these Terms;
  • fraud or suspected fraud;
  • a significant safety concern;
  • abusive or unlawful conduct;
  • a legal or regulatory requirement;
  • a material security risk; or
  • conduct that creates significant risk to NZLA, its systems or its community.

Where appropriate in the circumstances, NZLA may warn you or provide an opportunity to respond before taking action.

Serious fraud, safety, security or legal issues may require immediate action without advance notice.

Suspending, terminating or deleting an NZLA account does not automatically cancel a subscription billed by Apple or another external billing provider.

You remain responsible for separately managing or cancelling an active subscription through the relevant billing provider.

Any payment obligations already incurred, along with sections of these Terms which by their nature are intended to continue after account closure, remain effective after termination.

19. Account and Data Deletion

Users may request deletion of their NZLA account through the in-app account or privacy settings made available for that purpose.

If you have an active subscription, you should cancel that subscription separately through the relevant billing provider before deleting your account.

In particular, deleting an NZLA account does not automatically cancel an Apple App Store subscription.

When an account is deleted, NZLA may delete, anonymise or de-identify associated personal information, subject to information that may reasonably need to be retained for purposes such as:

  • financial and transaction records;
  • fraud prevention;
  • security;
  • moderation records;
  • dispute resolution; and
  • legal or regulatory obligations.

Public content may also remain temporarily or permanently within third-party search engine caches, internet archives, quoted replies or other systems outside NZLA’s reasonable control.

Further information about account deletion and data retention is available in our Privacy Policy.

20. Disclaimers and Limitation of Liability

NZLA aims to provide the Service with reasonable care and skill. However, internet-connected services, automated tools, third-party data and user-generated content may occasionally be unavailable, delayed, incomplete or inaccurate.

To the maximum extent permitted by law:

  • we do not guarantee uninterrupted or error-free access to every feature;
  • we do not guarantee that third-party weather, mapping, AI, environmental or other external information will always be accurate or current;
  • users remain responsible for independently checking information where accuracy or safety is important; and
  • NZLA will not be liable for indirect or consequential business losses where such liability may lawfully be excluded.

You are responsible for keeping copies or backups of information that is particularly important to you where it would be reasonable to do so.

Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that cannot lawfully be excluded or limited.

Where NZLA is liable to you under applicable law, any limitation of that liability contained in these Terms applies only to the maximum extent permitted by law.

21. Indemnity

To the extent permitted by law, you are responsible for losses, costs or claims reasonably incurred by NZLA as a direct result of your:

  • unlawful conduct;
  • intentional misuse of the Service;
  • infringement of another person’s intellectual-property or privacy rights; or
  • serious breach of these Terms.

This section does not require you to indemnify NZLA for losses caused by NZLA’s own unlawful conduct, breach, negligence or matters for which liability cannot lawfully be shifted to you.

22. New Zealand Consumer Rights

Nothing in these Terms is intended to exclude, restrict or modify any rights you have that cannot legally be excluded.

Depending on the circumstances, you may have rights under New Zealand legislation including:

  • the Consumer Guarantees Act 1993;
  • the Fair Trading Act 1986;
  • the Privacy Act 2020; and
  • other applicable New Zealand consumer protection laws.

If any provision of these Terms conflicts with a right or obligation that cannot legally be excluded, the applicable law prevails to the extent of that conflict.

23. Governing Law and Disputes

These Terms and the relationship between you and NZLA are governed by New Zealand law.

If you have a concern or dispute, we encourage you to contact us first so that we have an opportunity to investigate and attempt to resolve it.

Email:

office@newzealandlawnaddicts.com

Nothing in these Terms prevents you from accessing any consumer dispute-resolution process, regulator, tribunal or New Zealand court that you are entitled to use.

24. Apple-Specific Acknowledgements

If you access NZLA through an iOS application downloaded from Apple’s App Store, you acknowledge that:

  • the agreement governing NZLA’s services is between you and New Zealand Lawn Addicts Limited, not Apple;
  • Apple is not responsible for operating or supporting the NZLA Service;
  • Apple is not responsible for NZLA content, user-generated content, NZLA subscriptions, claims relating to NZLA services or NZLA’s operation of those services, except to the extent of Apple’s own obligations;
  • Apple billing, subscription management, cancellation and refund processes remain governed by Apple’s applicable rules;
  • Apple and its subsidiaries are third-party beneficiaries of the provisions of these Terms that relate to use of the iOS application and may enforce those provisions; and
  • nothing in these Terms alters Apple’s Standard Licensed Application End User License Agreement or limits any consumer rights that cannot lawfully be excluded.

Apple’s Standard Licensed Application End User License Agreement is available at:

https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

25. Changes to These Terms

NZLA may update these Terms from time to time to reflect changes to the Service, technology, subscriptions, legal requirements, security practices or operational requirements.

The most recent version will display its “Last Updated” date at the top of this page.

Where reasonably appropriate, we will communicate material changes to users through the Service, website, email or another suitable method.

Changes to these Terms will not retrospectively remove statutory rights that have already accrued to you.

Your continued use of the Service after updated Terms take effect will constitute acceptance of the updated Terms where permitted by law. If you do not agree to updated Terms, you may stop using the Service and, where applicable, cancel your subscription.
